Terms of Service

1. Service Description

AgentFabrica is an AI-powered social media content generation, scheduling, and publishing platform offered as a cloud-based subscription service. The service is provided by Agent Fabrica Teknoloji Ticaret Limited Şirketi ("AgentFabrica").

2. Account Creation

• You must be 18+ (authorized representative for company accounts)
• Provide accurate and current information
• You are responsible for account security (password, 2FA)
• One account per company; multiple accounts prohibited

3. Subscription and Payment

• Monthly or annual plans, prices on the pricing page
• Payment is taken by card through the payment institution shown on the payment screen
• Tax-inclusive/exclusive prices clearly indicated
• Card payments in Türkiye are not charged automatically; a renewal payment link is emailed at the end of the period. Turn off renewal with the "Turn off renewal" button on the Subscription and Usage page
• Pre-contract information and withdrawal: Pre-Contract Information Form and Distance Sales Agreement
• 20% discount on annual billing
• Launch discount on monthly billing: the first 3 payments are 35% off (25% on reporting plans, no discount on add-ons)
• Free trial terms:
  • Length: 10 days on self-serve plans. Enterprise, E-Commerce Premium, E-Commerce Enterprise, Plus Enterprise and Network plans have no trial; they get a free setup call instead.
  • Trial scope: account connections, reports, the content calendar, team, product sync, the GEO audit and brand profile drafting work as on the plan. These open up to a trial allowance set by plan size, and fully on the paid plan: image generation, story generation, video generation, UGC video generation, caption writing, market and competitor queries, the AI assistant, voice-over and music, report commentary and AI support replies. Brand, user and storage limits match the plan.
  • Reminder: an e-mail is sent 2 days before the trial ends.
  • Trial started with a card (international payment institution): when the trial ends the first period is charged to the saved card. The first 3 payments are 35% off (25% on reporting plans).
  • Trial started without a card: nothing is charged. When the trial ends, a payment link for the first period is e-mailed. If it is not paid within 7 days the account moves to the free tier; no new quota opens meanwhile. If online payment is not available on that date, your request is passed to our team and the account moves to the free tier.
  • Cancelling: cancel the trial any time from the Account screen. If you started with a card and cancel before the end, nothing is charged; access lasts until the trial ends.
  • One trial: each person and business can try once. To check this, only irreversible digests of e-mail, phone, web domain, connected business accounts, card, IP prefix and device data are kept for 24 months. If you connect a business account that was already used in a trial, the trial ends at that moment; you can continue with the launch discount.
  • Your data is not deleted when the trial ends.

4. Acceptable Use

You agree not to:

• Generate illegal, violent, hateful, harassing, or sexually explicit content
• Infringe copyright or trademark
• Upload an image of an identifiable real person without that person's explicit consent; talking-video and other likeness features may only use your own face or a face you have consent to use
• Create content that impersonates a real person (celebrity, public figure, competitor or acquaintance) or shows them saying something they did not say (deepfakes)
• Run spam, phishing, or disinformation campaigns
• Reverse-engineer or scrape the service
• Exceed API rate limits or use bots
• Create accounts on behalf of others without permission

Violations may result in suspension or termination without refund.

5. Generated Content

• Copyright (where applicable) of AI-generated content belongs to you
• You are responsible for legal compliance of generated content
• We guarantee service quality but not perfect AI output
• Brand assets and prompts remain your property

6. Service Level

• 99.5% uptime target (99.9% on Enterprise)
• Scheduled maintenance announced in advance

7. Limitation of Liability

To the extent permitted by law, AgentFabrica's total liability is limited to fees paid in the last 12 months. We are not liable for indirect, incidental, or consequential damages (lost data, lost revenue, reputation damage).

8. Termination

• Turn off renewal anytime (panel → Subscription and Usage → Turn off renewal); your plan stays open until the end of the paid period
• We may terminate for breach
• 30-day window to download or delete data after termination

9. Governing Law

This agreement is governed by the laws of the Republic of Türkiye. Disputes are subject to the jurisdiction of Istanbul Central Courts. Consumer disputes require mediation first.

10. Compliance with Third-Party Platform Policies

Each social platform connected through AgentFabrica is governed by its own terms. Both the user and AgentFabrica commit to the following official policies:

• TikTok: Marketing API Terms of Service, Developer Terms of Service, Brand Guidelines, and Community Guidelines.
• Meta: Platform Terms, Marketing API Terms, Brand Guidelines.
• LinkedIn: Marketing Developer Platform Terms.
• X / Twitter: Developer Agreement and Policy.

Producing, automating, or using accounts in violation of any platform policy is prohibited and triggers account suspension. If a platform restricts or terminates AgentFabrica's integration, the affected features may become unavailable.
